These Terms and Conditions (“Terms”) govern the services provided by Dispute Ease (“the Company”) and set forth the responsibilities of our clients (“the Client”). By using our website www.disputeease.com.au or engaging our services, the Client acknowledges and agrees to comply with these Terms.

1. Scope of Services

Dispute Ease assists clients in preparing and managing disputes with banks, merchants, or financial institutions (“the Claim”). This includes reviewing details, compiling necessary documentation, and providing the Client with the prepared dispute package.

2. Fees and Refund Policy
2.1 Upfront Fee

– The Client agrees to pay an upfront fee of AUD $99 AUD before the commencement of work.
– This fee covers the time, effort, and resources spent by Dispute Ease in preparing the dispute package.

2.2 Refund Policy

– Non-Refundable Upfront Fee: The upfront fee is non-refundable under any circumstances,
– 20% Commission: The commission fee of 20% is payable only upon successful recovery of funds. This commission is non-refundable once paid.

3. Client Obligations

The Client acknowledges that their cooperation is critical for the success of the dispute process and agrees to the following responsibilities:

3.1 Duty to Notify of Claim Outcome

– The Client must notify Dispute Ease of the outcome of their Claim within 90 days of receiving a response from their bank, merchant, or financial institution.
– Notification must be made in writing and include supporting details of whether the Claim was successful or unsuccessful.

 3.2 Timely Communication

– The Client agrees to respond promptly to any inquiries or requests for updates made by Dispute Ease during and after the dispute process.

4. Penalty for Non-Compliance

4.1 Failure to Notify

– If the Client fails to notify Dispute Ease of the outcome of their Claim within 90 days of receiving the decision, they agree to pay a penalty fee of AUD $10,000.
– This penalty is enforceable regardless of whether the Claim is successful or unsuccessful, as the Client has a duty to inform Dispute Ease of the outcome.

5. Limitation of Liability

Dispute Ease will not be held liable for:

– Any delays or adverse outcomes resulting from the Client’s failure to provide accurate or timely updates.
– Decisions made by banks, merchants, or financial institutions, as Dispute Ease cannot guarantee the success of any Claim.

 6. Confidentiality

Dispute Ease will maintain strict confidentiality regarding all information shared by the Client and will not disclose it to third parties except as required by law or necessary to fulfill the dispute process.

7. Governing Law

These Terms and Conditions are governed by the laws of Australia. Any disputes arising under these Terms shall be resolved exclusively in the courts of Australia.
